These Terms of Service ("Terms") govern your use of the websites, applications, biometric authentication platform, and related services (the "Service") provided by Smiley Pay Limited ("Smiley Pay," "we," "our," or "us").

1. The Service

Smiley Pay provides smile-based biometric authentication for employee time & attendance, event check-ins, and membership verification. Certain features — including Smiley Payments — are in development and not yet generally available.

2. Eligibility

You must be at least 18 years old to use the Service.

3. Accounts

You are responsible for safeguarding your credentials and for the accuracy of the information you provide.

4. Biometric Enrollment and Consent

Biometric authentication requires voluntary enrollment and consent per our Biometric Consent Form and Biometric Information Policy.

5. Authentication Is Probabilistic

Biometric authentication may produce failed or incorrect results. You are responsible for maintaining operational fallbacks for your use case.

6. Prohibited Uses

The Service is not for emergency services, life-safety systems, or critical infrastructure. You may not enroll others without their consent or violate applicable biometric privacy laws.

7. Fees and Trials

Paid plans are billed as described at purchase. Trial periods last 30 days unless otherwise stated.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT ERROR-FREE AUTHENTICATION.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.
